F/V “Rich Endeavor” (O.N. 1293024), a 1988 H & H Osmond Beale 37’ commercial fishing vessel, together with her machinery, equipment, appurtenances, etc. (“Vessel”).
Date and Time of Sale:         Thursday, October 3, 2024 at 11:30 AM
Location of Sale:                   44 Concord Dr. Hermon, Maine
Terms of Sale:  All persons will be required to register with the Marshal to bid and must agree to the terms of sale. The Vessel will be sold to the highest eligible bidder at the public sale. The sale is subject to confirmation by the Court. A $5,000 deposit (nonrefundable as to the highest bidder) via bank check or certified U.S. Funds made payable to the U.S. Marshals Service shall be deposited with the Marshal as a qualification to bid. The successful bidder will be required to enter into a purchase and sale Agreement with the Marshal at the conclusion of the sale. The balance of the purchase price shall be paid to the Marshal via bank check or certified U.S. funds within 5 business days of the conclusion of the sale. The minimum bid is $5,000. Machias Savings Bank has the right to bid without paying a deposit, and it may credit bid the amount of its preferred maritime lien as well as all costs it has advanced. The method, order of sale, and bidding increments are at the discretion of the Marshal. The sale is subject to confirmation by the Court. Following confirmation of the sale by the Court, the Marshal will provide the successful bidder with a bill of sale for the Vessel. The Vessel will be sold by the Marshal “AS IS” “WHERE IS” and “WITH ALL FAULTS.” There is no warranty relating to title, possession, quiet enjoyment, or the like in this disposition. The successful bidder must take possession of the Vessel within 7 days after confirmation of the sale by the Court. Persons attending the public sale or inspecting the Vessel do so at their own risk and will be required to sign a release holding the United States, the Marshal, Machias Savings Bank, Central Maine Auction Center, and their deputies, agents, employees, and attorneys harmless from any liability, including for a released party’s negligence. Other terms may be announced at the public sale, which could include changes to these terms as published.
